Aksi BMI Hongkong Datangi KJRI
BMI (Buruh Migran Indonesia) kembali beraksi didepan kantor KJRI (Konsulat Jendral Republik Indonesia) Hongkong ,aksi yg diarak dari jalan sebelah gedung Sogo Causeway Bay dengan sekali duduk tiga kali melangkah menyuarakan menolak GFMD (Global Forum on Migration and Development ) yang berlangsung diManila Philippines pada tgl 28-29 Oktober.
Ketua IMWU (Indonesia Migrant Workers’ Union ) Rusemi mengatakan “Demo ini kami lakukan sebagai penolakan GFMD karena dalam diskusi tersebut kami tidak dilibatkan , kami ingin disertakan dalam rancangan undang –undang yang akan mereka buat,sebab dalam hal ini kami yang tau kondisi sebenarnya, dari pada itu undang undang yang akan mereka buat nantinya juga untuk kita,tegasnya.
“Forum tersebut membicarakan bagaimana cara memperbanyak pengiriman tenaga kerja ,mereka menganggap bahwa Buruh Migrant adalah pendapatan Negara, Mereka lebih mementingkan keuntungan,tanpa melihat bagaiman cara melindungi ,
kami ingin perlindungan kita juga didiskusikan.”menurutnya lagi sampai sekarang gaji kita diHongkong belum kembali seperti semula $3860 ,selain itu potongan gaji dari $21000 yang kini menjadi $15000 ,berlaku sejak ditanda tangani oleh Direktor Jendral Pembinaan Penempatan Tenaga Kerja dengan Nomer :KEP.186/PPTKI/VII/2008 ,belum efektif , masih banyak agen yang melakukan pemotongan gaji sebanyak $21000, dan masih banyak gaji yang dibawa standar (underpayment).
Berbagi kasus yang sering menimpa BMI-Hongkong hingga kini masih terus bermunculan seperti yang dituturkan oleh BMI asal Lampung yang kini sedang menunggu kasusnya selesai dan ditampung oleh Selter KOTKIHO , Karti menuturkan selama Sembilan bulan tidak digaji ,Job yang diterimapun tidak sesuai dengan yang tertulis dikontrak kerja ,tidur jam 12 malam tanpa diberi kamar tidur dan mengunakan sofa ruang tamu sebagi tempat istirahatnya, ditambah lagi libur setiap minggu yg seharusnya diberikan oleh majikan kepada BMI dikurangi menjadi dua kali libur dalam sebulan tanpa mendapatkan ganti uang dari lemburanya “ saya pernah protes sama majikan tentang libur yang hanya dikasi sebulan dua kali, majikan bilang itu sudah peraturan dari agensi padahal dikontrak kerja kan setiap minggu libur,” ungkapnya.
Saat penulis sedang mengikuti jalannya demo ,tiba-tiba didatangi perempuan yang mengaku bernama Nurjana ,Nurjana mengatakan bahwa sering dipukul oleh anak majikannya yang berusia 16 tahun hingga menimbulkan bekas–bekas hitam ditubuhnya ,selain itu majikannya tidak pernah memberi sarapan pagi dan makan siang selama bekerja,yang lebih menghawatirkan lagi Nurjana tidur satu kamar dengan majikan lelakinya dengan ranjang bertingkat ,Nurjana diranjang tingkat atas sedang majikan lelakinya tidur diranjang bawah.“saya sering kesakitan ketika dipukul oleh anak majikan pakai sapu”keluh BMI asal Kendal Jawa Tengah itu.
Demo Minggu (26/10) yang diorganisir oleh CMR (Coalition for Migrants Rights) ,juga diikuti dari Anggota CMR seperti IMWU(Indonesia Migrant Workers’ Union ,KOTKIHO (Koalisi Organisasi Tenaga Kerja Indonesia ,NDWA (Nepalese Domestic Workers’ Union ) ,FDWU (Filipino Domestic Workers’Union ) ,dan Asian Migran Centre.
Menyikapi dari keadaan tersebut Sudah seharusnya Pemerintah memberi perhatian kepada BMI sebagai sumber devisa Negara yang harus dilindungi baik ketika masa training di PJTKI ,Pemberangkatan dan Penempatanya, mengenakan sangsi bagi para PJTKI maupun Agensi yang kurang bertanggung jawab terhadap BMI.

STOP UNDERPAYMENT!
USA THE EMPLOYER’ LAVY AS COMPENSATION FUND FOR FDWs!
We ,the members of the Coalition for Migrants’ rights (CMR) representing Filipino, Indonesia ,Thailand, Nepalese,sri lankan,and other migrant nasionalities in hong kong have come together to air our voice to the 2nd Global Forum on Migration Development (GFMD) which will bi held on 28-29 october ,in manila ,filipines.
GFMD is in inter –governmental forum that aims to “maximize the gains “ of migration ,instead of protecting and promoting the human rights of migrant workers the GFMD promotes temporary, vulnerable labor migration and making the migrants bear the burden of development ,reducing the government responsibility and accountability and ensuring more profits for companies.
Migrant domestic workers in hongkong contribute about 1% of the country ‘s GDP. Despite hongkong’s adherence to internasional standards ,boasting a world-class society and athics,yet.we are treated like beggars and slaves who are made to work on average 16 hours each day, paid less, and subjected to dehumanizing conditions and various forms of discriminations .our low-paid,marginalized and abused status is a grave injustice; it reflects HK;s disrespect of the human rights,social status and dignity of women migrants and domestic workers.
The governments claims thet they are after the rights and welfare of migrant workers,however,migration police and practices are largely discriminatory and exploitative ,and therefore fail to protect migrants’ human rights as well as cause,reinforece,or intensify gender ,class and systematic abuses . migration and development policies ahould be built upon the principles of human security with dignity,justice and equality for all.
We therefore demand the follwing migrant workers’ rights and labor policies reform based on the principles laid out in the united nations declaration on the rights to development and the core united nations (UN) and internasional labor organization (ILO) standards and convention :
- In the past three years the HK government increased the salary of FDWs of HK$50 in 2005; HK$80 in 2006; HK$80 in 2007; and HK$100 in Juni 2008 bringing the minimum Allowable wage of FDWs up to HK$3,860.but these raised is still indufficient to make-up for previous wage cuts .therefore, CMR demands to bring back the MAW to the previous HK$3.860/month.
- no to discrimination ,scrap the NCS and 2-week rule. The exclusion of the immigration policies in the anti-racial discrimination bill manifests the discriminatory treatment of FDWs .for over a decade now.CMR members have campaigned for the scrapping of the NCS which puts the FDWs in a disadvantage and discriminatory situation as womwn and as foreigners .the NCS applies only to FDWs and not for professional and expatriates,and disqualifies FDWs from gaining residency and from reunting with their families to live with them in HK. Therefore, the NCS violates CEDAW, CERD, and ICESCR which is inconsistent with the principles of Equal Opportunities Commission promoting racial harmony in HK.
- end Overcharging by recruitment agencies .we are calling the hongkong government to look after those recruitment agencies that abused migrant workers by collecting exorbitant fees. the effective punishment of exploitative placement agencies ,abusive employers and illegal recruiters.
- migrants representation in economic development ,migration and other policy reforms.CMR advocates for the implementation of migrant savinegs, economic development and reintegration programsto prepare migrants for their return home and make them direct partisipants in the development prosess. We firmly believe that migrant workers ,local workers, and undocumented workers are all entitled to the same basic rights enshrined in the united nations declarastion on the right to development.
CMR continues to reach out to our fellow migrants , women and allied trade unions and NGOs, church based organization and local workers to resist and struggle against these exploitative migration and development agendas of the GFMD . we shall continue to strengthen our global solidarity and intervene at the GFMD and all international f
